Common use of Waiver of Objection Clause in Contracts

Waiver of Objection. Any Class Member who does not file a timely written Objection to the Settlement shall waive the right to object or to be heard at the Final Approval Hearing and shall be forever barred from making any Objection to the Settlement or seeking review of the Settlement by appeal or other means. Any Class Member who does not file a timely written Objection to the Settlement will be bound by this Agreement and the Final Approval Order and Judgment, including the Release described in Section 15 of this Agreement.

Any Settlement Class Member who does not file a timely written Objection fails to object to the Settlement in the manner described in the Notice and consistent with this Section shall waive be deemed to have waived any such objection subject to a final determination by the right Court, and shall not be permitted to object to any terms or to be heard approval of the Settlement at the Final Approval Hearing Hearing, and shall be forever barred foreclosed from making seeking any Objection to the Settlement or seeking review of the Settlement or the terms of the Agreement by appeal or other means.
