Common use of Waiver of Class Action Clause in Contracts

Waiver of Class Action. EACH PARTY EXPRESSLY WAIVES THEIR RIGHT TO FILE A CLASS ACTION OR SEEK RELIEF ON A CLASS BASIS. All proceedings, whether in arbitration or litigation, will be conducted in their individual capacity only. The Parties agree that each may bring claims against each other only in their individual capacity and not as plaintiff or dass of member in any purported dass or representative proceeding. Notwithstanding anything to the contrary, the Parties may seek injunctive relief and any other equitable remedies from any court of competent jurisdiction to protect its respective intellectual property rights, including patents, copyrights, moral rights, trademarks, and trade secrets.
