Waiver of Class Action. THIS PASSENGER AGREEMENT PROVIDES FOR THE EXCLUSIVE RESOLUTION OF DISPUTES THROUGH INDIVIDUAL LEGAL ACTION OR ARBITRATION ON YOUR OWN BEHALF INSTEAD OF THROUGH ANY CLASS OR REPRESENTATIVE ACTION. IF YOUR CLAIM IS SUBJECT TO ARBITRATION UNDER SUBSECTION (b) ABOVE, THE ARBITRATOR SHALL HAVE NO AUTHORITY TO ARBITRATE CLAIMS ON A CLASS ACTION BASIS. If we cannot resolve the dispute amicably through our support team, you and Ibinex agree that any dispute arising under this Agreement shall be referred to Xxxxx County Court (Harju Maakohus) in Tallinn, Estonia. This Agreement shall be governed by and construed in accordance with the Laws of Estonia. You and Ibinex hereby expressly waive the right to participate in a class action lawsuit, joint actions by several plaintiffs or class-wide arbitration.
