Common use of WAIVER/ENFORCEABILITY Clause in Contracts

WAIVER/ENFORCEABILITY. No delay in enforcing our rights will affect your obligations under this Agreement. If we waive any of the provisions of this Agreement, such waiver will apply only on that occasion and is not sufficient to modify the terms and conditions of this Agreement. If there is a conflict between this Agreement and Applicable Law, this Agreement will be considered changed to the extent necessary to comply with Applicable Law. Except as described in the arbitration provision, found in Section ▇.▇▇ of this Agreement, if any provision of this Agreement is deemed to be invalid, illegal or otherwise unenforceable, that provision may continue to be enforceable to the extent permitted by the court, and the remainder of that provision will no longer be considered part of this Agreement. All other provisions of this Agreement will remain in full force and effect.
