Common use of Vested Benefits Clause in Contracts

Vested Benefits. In addition to the payments and benefits set forth in this Section 4.02, amounts which are vested benefits or which Employee is otherwise entitled to receive under any plan, program, policy or practice (with the exception of those relating to severance, if any) on the date of termination, shall be payable in accordance with such plan, policy, practice or agreement.

Vested Benefits. In addition to the payments and benefits set forth in this Section 4.023.02, amounts which are vested benefits or which Employee Executive is otherwise entitled to receive under any plan, program, policy or practice (with the exception of those relating to severance, if anyany severance or equity incentive plan) on the date of termination, shall be payable in accordance with such plan, policy, practice or agreement.

The treatment of the Subject Options shall be governed by the Award Agreement.
