Vendor Developments. The Vendor must provide the Owner, through the NDAB or the Owner's vice president and/or director of product development, with reasonable prior notice of any PCS Product developments, innovations and/or technological advances (collectively "Vendor Developments") relevant to the System prior to giving such notice to any other Customer or otherwise making any such Vendor Development public within the relevant marketplace; provided that the Vendor will not be obligated to provide the Owner such notice before any other Customer if doing so would not be reasonable under the circumstances and/or otherwise breach any contractual obligation to any other Customer; provided further that any such notice pursuant to this subsection 2.11.1 need not include any information originated by another Customer which is proprietary to such other Customer of the Vendor. For the purposes of this subsection 2.11.1 the term "Vendor" includes the Vendor and its affiliates and subsidiaries.

Vendor Developments. Subject to any limits set forth in the respective agreements between Vendor and its other customers, Vendor shall provide Cricket, or cause to be provided to Cricket, with reasonable written notice of any significant Product developments, innovations or technological advances (collectively “Vendor Developments”), which are planned to be made generally available to Vendor’s U.S. customers and are relevant to the Products or Systems, within a reasonable time of providing such notice to any other customer or otherwise making any such Vendor Development public. Vendor will support the New Technology Capacity and Performance and System Evolution Requirements described in Exhibit O.

Vendor shall provide Cricket, or cause to be provided to Cricket, through Cricket’s chief technical officer (or in the absence of such officer, to Cricket’s chief executive officer), with reasonable written notice of any Product developments, innovations or technological advances (collectively “Vendor Cricket Communications Proprietary and Confidential Information Developments”) relevant to the Products or Systems simultaneous to giving such notice to any other customer or otherwise making any such Vendor Development public. For the purposes of this Section the term “Vendor” includes Vendor and its Affiliates and subsidiaries. Vendor agrees that it shall develop and make Products available in accordance with the terms of Exhibit O.
Vendor Developments. The Vendor shall provide Impsat, through Impsat's Chief Technical Officer or Marketing Director, with reasonable prior notice of any product developments, innovations and/or technological advances that had been made by the Vendor and may be relevant to the Subnetwork; provided, that any such notice pursuant to this Section 8.2 need not include any information originated by another customer of the Vendor which is proprietary to such other customer. For the purposes of this Section 8.2, the term "Vendor" includes the Vendor and its Affiliates and Subsidiaries.
