Value Pricing. Notwithstanding the City’s approval of any prices listed in Exhibit 5, a major inducement to the City to enter into this Agreement is Tenant's agreement that it will comply with the following in establishing prices. Tenant must not charge in excess of Value Prices, as defined below, for the Merchandise or any other products from time to time approved in writing by the Commissioner for sale from the Retail Space. For the purposes of calculating Value Prices as set forth below, the term "city of Chicago" means the area bounded by Congress Expressway on the South, North Avenue on the North, Lake Michigan on the East, and Franklin Street on the West, and the term "Chicago Metropolitan Area" means ▇▇▇▇ County and all counties contiguous thereto within the State of Illinois.
Value Pricing. Concessionaire acknowledges City’s objective to provide DEN patrons and employees high quality goods and services at reasonable prices. Accordingly, Concessionaire covenants that all goods and services sold by Concessionaire shall meet the Value Pricing as follows:
1. For merchandise with a pre-printed price affixed by the manufacturer or distributor, the selling price at DEN shall not exceed the pre-printed price;
2. For nationally and locally branded Concession Locations that are also represented off-DEN in the Denver-Aurora Statistical Area, the selling price for goods and services at DEN shall not exceed the selling price for the same goods and services at the closest off-DEN establishment of the same brand name by more than ten percent (10%); and
3. For all non-branded, proprietary, or branded Concession Locations not represented off-DEN in the Denver-Aurora Statistical Area, the selling price for goods and services at DEN shall not exceed the average selling price for similar or equivalent goods (of like size and quality) and services at three Price Benchmark Establishments, as described below, by more than ten percent (10%).
Value Pricing. The City has established a Value Pricing policy for all Tenants at the Airport. The policy generally requires Tenants to charge a price for a product or service at the Airport as the same price charged for the same product or service at similar stores in the City (each hereinafter referred to as a “Benchmark Store”). Benchmark Stores will be proposed by the Tenant subject to approval by the City. The following locations and areas shall be excluded when establishing Benchmark Stores: hotel restaurants or kiosks, bus and train transportation centers, entertainment centers, arenas, theaters, convention centers or similar venues. Benchmark Store exclusions may change throughout the Term as determined necessary by the City. If the Tenant or its Subtenants currently operate the exact other locations in the City of Chicago, then these locations may be designated Benchmark Stores. Otherwise, Benchmark Stores will be selected based on stores that are comparable to the proposed concept. Notwithstanding the aforementioned exclusions, in the case of a news and gift store where Tenant or its Subtenant currently operate a same-brand location in the City of Chicago, in a transportation center, and that location has its own customer walk-up street access, the City may consider allowing Tenant to propose that location as a Benchmark Store. In such a case, the Value Pricing policy prohibits ▇▇▇▇-up of pricing higher than that of the applicable Benchmark Store because that store already is in a transportation center. Other Pricing Policy. The Commissioner may adopt other reasonable pricing policies, with which Tenant and Subtenants shall comply, to restrict overcharging and price gouging by Subtenants due to their dominant market position and any exclusive rights granted, but in no event shall the Commissioner require prices lower than the established Value Pricing. Tenant must submit to the CMR, within 30 days after the end of each Lease Year, or as requested from time to time by the Commissioner or CMR, a pricing report demonstrating compliance by Tenant with the Value Price requirements. Any prices that the Commissioner or CMR determines to be inconsistent with the Value Price requirements must be adjusted accordingly. At any time, and from time to time, the Commissioner or CMR may review the prices of the Products then being offered for sale by Tenant and require adjustments in prices of the Products or particular items in order to comply with the Value Price requirement...
Value Pricing. Manager and the Authority acknowledge and agree that all pricing for the Services must be in compliance with the requirements set forth in the Metropolitan Pier and Exposition Authority Act (70 ILCS 210/1 et seq.)
Value Pricing. Comparable price(s) to similar or equivalent goods and services sold in comparable off-DEN locations within the Denver-Aurora Statistical Area, as described in Section 7.03.
