Common use of Value Pricing Clause in Contracts

Value Pricing. Notwithstanding the City’s approval of any prices listed in Exhibit 5, a major inducement to the City to enter into this Agreement is Tenant's agreement that it will comply with the following in establishing prices. Tenant must not charge in excess of Value Prices, as defined below, for the Merchandise or any other products from time to time approved in writing by the Commissioner for sale from the Retail Space. For the purposes of calculating Value Prices as set forth below, the term "city of Chicago" means the area bounded by Congress Expressway on the South, North Avenue on the North, Lake Michigan on the East, and Franklin Street on the West, and the term "Chicago Metropolitan Area" means ▇▇▇▇ County and all counties contiguous thereto within the State of Illinois.
