VALID REQUESTS. A request for a rescission vote must be accompanied by proof of approval of the request by at least 30% of the employees of the representation unit covered by the fair share fee agreement. Proof of approval shall require: a. valid signatures of individuals who were on payroll and members of the representation unit as of the first pay day date to occur no sooner than 90 days and no later than 60 days before the expiration of the fair share fee agreement with the unit in question. Printed names must accompany the signatures so that signatures may be verified. b. a statement that the intent of the signer is to secure approval for a vote to rescind the fair share fee agreement for the signer’s representation unit. VALID REQUESTS. 2.1 A request for service under this Rate Schedule PAL shall be valid as of the date received if it complies with this Section and contains adequate information on all of the items specified in Section 2.2, subject to any necessary verification of such information and to the following: (a) A request shall not be valid and Transporter shall not be required to grant any such request: (1) which would require the construction, modification, expansion, or acquisition of any facilities; provided, however, that Transporter may agree in its reasonable discretion to construct, modify, expand, or acquire facilities to enable it to perform such services; (2) if Transporter determines, based on the credit analysis referenced in Section 2.2(b), that Shipper does not possess sufficient financial stability to make it reasonably likely the service provided hereunder will be paid for on a timely basis; (3) if the service requested would not comply with this Rate Schedule PAL; or (4) if the service requested is at less than the applicable maximum rate; provided, however, that Transporter may agree to provide service hereunder at a discount consistent with this Rate Schedule PAL. (b) Transporter shall promptly notify Shipper if it cannot satisfy an otherwise valid request because such request is incomplete or does not comply with this Rate Schedule PAL. Any request shall be null and void unless it is substantially complete and complies with this Rate Schedule. In the event a request is substantially but not entirely complete, Transporter shall inform ▇▇▇▇▇▇▇ in writing of the specific items needed to complete the PAL Agreement, after which Shipper shall have fifteen (15) days to provide the specified information. In the event such information is not received within fifteen (15) days, ▇▇▇▇▇▇▇'s request shall be null and void. RATE SCHEDULE PAL PARKING AND LENDING SERVICE (c) Transporter shall tender a PAL Agreement to Shipper for execution when ▇▇▇▇▇▇▇'s request for service is accepted. Unless waived by Transporter, a request for service shall be invalid if ▇▇▇▇▇▇▇ fails to execute a PAL Agreement hereunder within thirty (30) days after a PAL Agreement has been tendered by Transporter for execution.
