Vacation Pay Out Rate. ‌ 12.13.1 Vacation Pay Out Rate provisions applicable to all unit employees, except for the “Fire Battalion Chief” classification: When selling vacation back to the City under 12.12 or pay for unused vacation under 12.7, vacation shall be calculated based on the regular FLSA pay rate. 12.13.2 Vacation Pay Out Rate provisions applicable to the “Fire Battalion Chief” classification only: Vacation paid out in accordance with sections 12.7 and 12.12.2 will be calculated on base salary. For purposes of this section, “base salary” shall mean a qualifying employee’s straight time hourly rate of pay, and shall not include overtime, skill pay, or other special salary differential(s) or pay.
