You warrant to Avadian all of the following: o You will only transmit eligible items o You will not transmit duplicate Checks o You will not re-deposit or re-present the original Check o You will properly endorse all Checks o Check images presented to us accurately represents all information on both sides of the Check o All information you provide to Avadian is accurate and true o You will comply with this Agreement and all applicable rules, laws and regulations o You are not aware of any factor that may impair the collectability of the item o You will safeguard Checks and maintain appropriate controls over your device, as set forth herein To the fullest extent allowed by law, you agree to indemnify and hold harmless Avadian from any loss relating to your breach of this warranty provision.
