Common use of Use After Termination Clause in Contracts

Use After Termination. Notwithstanding the provisions of § XII(F)(1) and § XII(F)(2) above, a Tribal Certificate of Exemption provided by a Tribe, Resident Tribal Member or Tribal Entity to a contractor for the purpose of construction, improvement, or renovation of real property as permitted in § III(A)(3) shall remain effective after the termination of this Agreement by the State until the contract is completed, but not to exceed a period of 12 months, provided, however, that such contract may not be expanded or extended after the State provides notice of its intent to terminate the Agreement; provided further that the use and benefit of such certificates shall not be extended beyond the termination of the Agreement where the Agreement is terminated by the State for cause or is voluntarily terminated by the Tribe.
