Upper Boundaries Clause Samples

The "Upper Boundaries" clause sets a maximum limit on certain obligations, liabilities, or quantities within an agreement. For example, it may cap the total amount a party can be required to pay in damages or restrict the maximum volume of goods to be delivered under a contract. By establishing these upper limits, the clause provides predictability and protects parties from excessive or unforeseen exposure, ensuring that risks remain manageable and clearly defined.
Upper Boundaries. The horizontal plane of the unfinished lower surface of the ceiling (which will be deemed to be the ceiling of the upper story if the Unit is a multi-story Unit, provided that in multi-story Units where the lower boundary extends beyond the upper boundary, the upper boundary shall include that portion of the ceiling of the lower floor for which there is no corresponding ceiling on the upper floor directly above such bottom floor ceiling).
Upper Boundaries. The horizontal plane of the lowest surface of the unfinished ceiling slab. In a Unit containing a room in which the ceiling is raised above the level of the ceiling in the rest of the Unit, the ceiling slab shall include the vertical slab or wall connecting the raised ceiling with the ceiling of the remaining portion of the Unit, and the upper boundary shall include the plane of the unfinished surface of the vertical slab or wall of the raised ceiling that joins the planes of the lowest surfaces of the unfinished horizontal portions of the ceiling slabs.
