Untimely Plan Implementation. If Contractor fails to achieve Plan implementation by January 1, 2023, it will pay liquidated damages of $25,000 per Calendar Day, not to exceed $500,000, unless any such delay is due to the Department’s failure to comply with the defined timeline. Contractor will pay this amount of liquidated damages for every full or partial Calendar Day until the Plan is fully implemented.

Untimely Plan Implementation. If Contractor materially fails to achieve Plan implementation by January 1, 2016, it shall pay liquidated damages of $1,000 per Calendar Day, unless any such delay is due to the Department’s errors or omissions or failure to comply with the defined timeline.
