Unrestricted Cash and Cash Equivalents. After the Consummation of the Plan, the Obligors shall have on a pro forma basis as of the Effective Date, taking into account net cash proceeds of the Stock Offering, the Convertible Note Offering and the Juniper Financing expected to be received within seven (7) days of the Effective Date, unrestricted cash and Cash Equivalents (as determined in accordance with GAAP) of not less than $1,250,000,000.
