Dans ces conditions, c’est à juste titre que nous pensons devoir utiliser l’expression droit uniforme pour désigner les seules règles unifiées de fond.25 The first characteristic of these uniform rules is to eliminate the issue of determining the applicable domestic legislation, by establishing common substantive private rules.26 The second, as pointed out by the same author, is that the effectiveness of uniform rules relies on their primacy over domestic legislation:
Uniform Rules. Uniform rules are widely spread throughout the Conventions, particularly from Article 1 to 52 in the 1999 Montreal Convention. By providing such a set – the MC – many conflict-of-law questions were eliminated and most choice-of- law problems were side stepped.7
