Unforeseen Difficulties. Except as otherwise expressly provided in Section 2.12 of the Agreement and in other Sections of the Contract Documents, the Contractor acknowledges that it has assumed the risk and that the Contract consideration includes such provisions as it deems proper for any unforeseeable obstacles or difficulties which it may encounter in the performance of the work.

Unforeseen Difficulties. Except as otherwise specified in the Contract Agreement: a) the Contractor accepts complete responsibility for having foreseen all difficulties and cost implications of successfully completing the Works; b) the Bid Price shall not be adjusted to take account of any unforeseen difficulties or costs; and c) The Scheduled Project Commissioning Date shall not be adjusted to take account of any unforeseen difficulties or costs. For the purpose of this Clause, unforeseeable difficulties include physical conditions like man-made or natural physical conditions including sub-surface and hydrological conditions which the Contractor encounters at the Project Site during execution of the Works.
Unforeseen Difficulties. All loss or damage arising out of the nature of the Work to be done under this Contract, or from any unforeseen obstructions or difficulties which may be encountered during the progress of the Work and in the prosecution of the same, shall be sustained by the Design Build Entity, except as may be otherwise specifically provided by the Contract Documents.
