Common use of Unfair Business Practices Clause in Contracts

Unfair Business Practices. The Design/Builder agrees, and will require all of the Design/Builder’s contractors and subcon- tractors and suppliers to agree, to assign to the awarding body all rights, title, and interest in and to all causes of action they may have under Section 4 of the ▇▇▇▇▇▇▇ Act (15 U.S.C. Section 15), or under the ▇▇▇▇▇▇▇▇▇▇ Act (commencing with Section 16700 of the Business and Professions Code), arising from the purchase of goods, services or materials, pursuant to the Contract Docu- ments or any subcontract there under. An assignment made by the Design/Builder, and all addi- tional assignments made by subcontractors and suppliers, shall be deemed to have been made and will become effective at the time the District tenders Final Payment to the Design/Builder, without further acknowledgment of the parties.
