Uncapped Liabilities Sample Clauses

Uncapped Liabilities. Notwithstanding any other provision in this Agreement, neither Party excludes or restricts in any way its liability for: (i) death or personal injury resulting from its own negligence or the negligence of its employees or agents acting in the course of their employment or agency; (ii) fraud or fraudulent misrepresentation; or (iii) breach of Clauses 23 (Intellectual Property Indemnities) or 24.4 (Confidentiality).
