Ullage Acknowledgment Sample Clauses

Ullage Acknowledgment. The Customer acknowledges that despite all reasonable care and attention on the part of the Company, damage and/or loss of Goods can sometimes occur through storage, handling & transportation (Ullage). The Customer agrees that except to the extent required by law and except where Clause 9.8 applies, the Company will have no liability to the Customer for Ullage as the Parties have taken this into account in negotiating the pricing for the Services in accordance with the Contract.
