Common use of Trustee, Paying Agent and Registrar Clause in Contracts

Trustee, Paying Agent and Registrar. Initially, IBJ Xxxxxxxx Bank & Trust Company, a New York banking corporation ("Trustee"), will act as Trustee, Paying Agent and Registrar. IBJ Xxxxxxxx Bank & Trust Company will also act as the Trustee for $275,000,000 aggregate principal amount of 9 1/2% Senior Subordinated Notes due 2007 (the "Senior Subordinated Notes"). The Company may appoint and change any Paying Agent, Registrar or co-registrar without notice to any Noteholder. The Company or any of its domestically incorporated Wholly Owned Subsidiaries may act as Paying Agent, Registrar or co-registrar.
