Common use of TRRO Certification Clause in Contracts

TRRO Certification. Before requesting unbundled access to a DS1 Loop, a DS3 Loop, DS1 Dedicated Transport, DS3 Dedicated Transport, or Dark Fiber Transport, including, but not limited to, any of the foregoing elements that constitute part of a Combination or that Intrado seeks to convert from another wholesale service to an unbundled network element (collectively, "TRRO Certification Elements"), Intrado must undertake a reasonably diligent inquiry and, based on that inquiry, certify that, to the best of its knowledge, Intrado's request is consistent with the requirements of the TRRO and that Intrado is entitled to unbundled access to the subject element pursuant to section 251(c)(3) of the Act. Intrado shall provide such certification using the automated method that Verizon makes available for that purpose. Intrado's reasonably diligent inquiry must include, at a minimum, consideration of any list of non-impaired UNE Wire Centers that Verizon makes or has made available to Intrado by notice and/or by publication on Verizon's wholesale website (the "Wire Center List") and any back-up data that Verizon provides or has provided to Intrado under a non-disclosure agreement or that is otherwise available to Intrado.

Intrado WCS shall provide such certification using the automated method that Verizon makes available for that purpose. IntradoWCS's reasonably diligent inquiry must include, at a minimum, consideration of any list of non-impaired UNE Wire Centers that Verizon makes or has made available to Intrado WCS by notice and/or by publication on Verizon's wholesale website (the "Wire Center List") and any back-up data that Verizon provides or has provided to Intrado WCS under a non-disclosure agreement or that is otherwise available to IntradoWCS.

Intrado Nettalk shall provide such certification using the automated method that Verizon makes available for that purpose. IntradoNettalk's reasonably diligent inquiry must include, at a minimum, consideration of any list of non-impaired UNE Wire Centers that Verizon makes or has made available to Intrado Nettalk by notice and/or by publication on Verizon's wholesale website (the "Wire Center List") and any back-up data that Verizon provides or has provided to Intrado Nettalk under a non-disclosure agreement or that is otherwise available to IntradoNettalk.

Intrado ENT shall provide such certification using the automated method that Verizon makes available for that purpose. IntradoENT's reasonably diligent inquiry must include, at a minimum, consideration of any list of non-impaired UNE Wire Centers that Verizon makes or has made available to Intrado ENT by notice and/or by publication on Verizon's wholesale website (the "Wire Center List") and any back-up data that Verizon provides or has provided to Intrado ENT under a non-disclosure agreement or that is otherwise available to IntradoENT.

Intrado Bandwidth shall provide such certification using the automated method that Verizon makes available for that purpose. IntradoBandwidth's reasonably diligent inquiry must include, at a minimum, consideration of any list of non-non- impaired UNE Wire Centers that Verizon makes or has made available to Intrado Bandwidth by notice and/or by publication on Verizon's wholesale website (the "Wire Center List") and any back-up data that Verizon provides or has provided to Intrado Bandwidth under a non-disclosure agreement or that is otherwise available to IntradoBandwidth.

Intrado Globetel shall provide such certification using the automated method that Verizon makes available for that purpose. IntradoGlobetel's reasonably diligent inquiry must include, at a minimum, consideration of any list of non-impaired UNE Wire Centers that Verizon makes or has made available to Intrado Globetel by notice and/or by publication on Verizon's wholesale website (the "Wire Center List") and any back-up data that Verizon provides or has provided to Intrado Globetel under a non-disclosure agreement or that is otherwise available to IntradoGlobetel.

Intrado PN shall provide such certification using the automated method that Verizon makes available for that purpose. IntradoPN's reasonably diligent inquiry must include, at a minimum, consideration of any list of non-impaired UNE Wire Centers that Verizon makes or has made available to Intrado PN by notice and/or by publication on Verizon's wholesale website (the "Wire Center List") and any back-up data that Verizon provides or has provided to Intrado PN under a non-disclosure agreement or that is otherwise available to IntradoPN.

Intrado PNG shall provide such certification using the automated method that Verizon makes available for that purpose. IntradoPNG's reasonably diligent inquiry must include, at a minimum, consideration of any list of non-impaired UNE Wire Centers that Verizon makes or has made available to Intrado PNG by notice and/or by publication on Verizon's wholesale website (the "Wire Center List") and any back-up data that Verizon provides or has provided to Intrado PNG under a non-disclosure agreement or that is otherwise available to IntradoPNG.

Intrado ▇▇▇ shall provide such certification using the automated method that Verizon makes available for that purpose. Intrado's ▇▇▇'▇ reasonably diligent inquiry must include, at a minimum, consideration of any list of non-impaired UNE Wire Centers that Verizon makes or has made available to Intrado ▇▇▇ by notice and/or by publication on Verizon's wholesale website (the "Wire Center List") and any back-up data that Verizon provides or has provided to Intrado ▇▇▇ under a non-disclosure agreement or that is otherwise available to Intrado▇▇▇.

Intrado Globetel shall provide such certification using the automated method that Verizon makes available for that purpose. IntradoGlobetel's reasonably diligent inquiry must include, at a minimum, consideration of any list of non-non- impaired UNE Wire Centers that Verizon makes or has made available to Intrado Globetel by notice and/or by publication on Verizon's wholesale website (the "Wire Center List") and any back-up data that Verizon provides or has provided to Intrado Globetel under a non-disclosure agreement or that is otherwise available to IntradoGlobetel.

Intrado BLC shall provide such certification using the automated method that Verizon makes available for that purpose. IntradoBLC's reasonably diligent inquiry must include, at a minimum, consideration of any list of non-impaired UNE Wire Centers that Verizon makes or has made available to Intrado BLC by notice and/or by publication on Verizon's wholesale website (the "Wire Center List") and any back-up data that Verizon provides or has provided to Intrado BLC under a non-disclosure agreement or that is otherwise available to IntradoBLC.

Intrado CPV shall provide such certification using the automated method that Verizon makes available for that purpose. IntradoCPV's reasonably diligent inquiry must include, at a minimum, consideration of any list of non-impaired UNE Wire Centers that Verizon makes or has made available to Intrado CPV by notice and/or by publication on Verizon's wholesale website (the "Wire Center List") and any back-up data that Verizon provides or has provided to Intrado CPV under a non-disclosure agreement or that is otherwise available to IntradoCPV.

Intrado MMG shall provide such certification using the automated method that Verizon makes available for that purpose. IntradoMMG's reasonably diligent inquiry must include, at a minimum, consideration of any list of non-impaired UNE Wire Centers that Verizon makes or has made available to Intrado MMG by notice and/or by publication on Verizon's wholesale website (the "Wire Center List") and any back-up data that Verizon provides or has provided to Intrado MMG under a non-disclosure agreement or that is otherwise available to IntradoMMG.

Before requesting unbundled access to a DS1 Loop, a DS3 Loop, DS1 Dedicated Transport, DS3 Dedicated Transport, or Dark Fiber Transport, including, but not limited to, any of the foregoing elements that constitute part of a Combination or that Intrado CBAD seeks to convert from another wholesale service to an unbundled network element (collectively, "TRRO Certification Elements"), Intrado CBAD must undertake a reasonably diligent inquiry and, based on that inquiry, certify that, to the best of its knowledge, IntradoCBAD's request is consistent with the requirements of the TRRO and that Intrado CBAD is entitled to unbundled access to the subject element pursuant to section 251(c)(3) of the Act. Intrado CBAD shall provide such certification using the automated method that Verizon makes available for that purpose. IntradoCBAD's reasonably diligent inquiry must include, at a minimum, consideration of any list of non-impaired UNE Wire Centers that Verizon makes or has made available to Intrado CBAD by notice and/or by publication on Verizon's wholesale website (the "Wire Center List") and any back-up data that Verizon provides or has provided to Intrado CBAD under a non-disclosure agreement or that is otherwise available to IntradoCBAD.

Intrado SLT shall provide such certification using the automated method that Verizon makes available for that purpose. IntradoSLT's reasonably diligent inquiry must include, at a minimum, consideration of any list of non-impaired UNE Wire Centers that Verizon makes or has made available to Intrado SLT by notice and/or by publication on Verizon's wholesale website (the "Wire Center List") and any back-up data that Verizon provides or has provided to Intrado SLT under a non-disclosure agreement or that is otherwise available to IntradoSLT.
