Tree Management. The City shall be responsible for the maintenance, preservation, protection, and removal of all trees on the Site. All trees planted on the Site by the League in accordance with the Park and Facility Development Process, which may be amended from time to time, shall become the absolute property of the City upon the issuance of a Final Acceptance Certificate (FAC) pursuant to City Policy “Corporate Tree Management Policy” (C456C). In the event that the League desires to maintain trees on the Site, the League shall obtain the prior written consent of the Deputy City Manager, which consent may not be unreasonably or arbitrarily withheld. Should the City remove any trees on the Site upon the League’s request, the League shall be responsible for all costs associated with the removal as per C456C.
