TRANSMISSION POINT LOCATION. Upon execution of this Agreement, Lessee shall, in consultation with Lessor, co-locate the Transmission Point for provision of the services contemplated by this Agreement with the MMDS and/or other facilities Lessee operates under lease agreement in Lessor's designated market. At Lessee's expense, Lessor shall prepare and file with the FCC any appropriate applications or amendments to previously filed applications, to secure a license to operate the four (4) Channels from said location. Lessee shall provide all legal and/or engineering personnel for this purpose or will have the right to approve any expenses incurred by Lessor in advance of Lessor incurring such expenses. If, upon review of Lessor's application, the FCC directs Lessor to amend, revise or modify the application or the terms of this Agreement to comply with FCC rules
