This may involve periodic health examinations or immunizations. 2.8 At the time of the expiration or termination of this Agreement, return all Medical Center property, including, but not limited to, books, equipment, and uniforms; complete all necessary records; and settle all financial and professional obligations. 2.9 Report immediately to the Program Director and to the Medical Center’s Office of General Counsel any inquiry by any private or government attorney or investigator and to the Program Director and Corporate Communications Department any inquiry by a member of the media, in regard to Medical Center business or patient-related matters. The Trainee agrees not to communicate with any inquiring attorney or investigator or member of the media, in regard to Medical Center business or patient- related matters, except for purposes of referral to the appropriate Medical Center office or department or as otherwise required by applicable law. 2.10 Permit and authorize the Medical Center to obtain from and provide to all proper parties any and all information as required or authorized by law or accreditation or licensing body. The Trainee understands that the Hospital encourages the Trainee’s full cooperation with any governmental investigation or inquiry. The Trainee agrees not to communicate with any inquiring private attorney or any members of the press except merely to refer such private attorneys to the Hospital’s legal office and to refer the press to the Hospital’s Public Relations Office.
2.3 2.2 Participate fully in required the educational and scholarly activities of the Program, including the performance of scholarly and research activities as assigned by the Program, Program Director, and/or as necessary for the completion of applicable graduate requirements. This obligation of Trainee includes participation in orientation and core curriculum. Trainee shall also attend all required educational conferences, assume responsibility for teaching and supervising other residents trainees and medical students, and participate in assigned Hospital, and Hospital Medical Center Staff committee activitiesactivities upon request.
2.3 Use Trainee’s best efforts to provide safe, effective, and compassionate patient care and present at all times a profession, courteous and respectful attitude toward all patients, colleagues, employees, visitors at the Hospital and other facilities/rotation sites to which the Trainee is assigned.
2.4 Fulfill the educational requirements of the Program, including in the areas of the six core competencies required by ACGME.
2.5 Provide clinical service: services:
2.4.1 Commensurate with his/her Trainee’s level of advancement and responsibilities. ;
2.4.2 Under appropriate supervision. supervision as directed by the Program Director;
2.4.3 At sites specifically approved by the Program and the Program. ’s Graduate Medical Education Committee (“GMEC”);
2.4.4 Under circumstances and at locations covered by the Florida State University College of Medicine professional liability insurance maintained for the Trainee in accordance with Section 5.4 below; and,
2.4.5 In accordance with the applicable Hospital Department’s policies and procedures, including, but not limited to, the Departments of Nursing, Professional Services, Financial Services, Social Services, and other Ancillary Services Departments in connection with the evaluation of appropriate discharge and post-hospital care for hospital patients
2.5 Develop and follow a personal program of self-study and professional growth under guidance of the Program’s teaching faculty that includes lifelong learning and demonstrates the Trainee’s ability to assume progressive and increasing responsibility for patient care.
2.6 Demonstrate competency in Patient Care, Medical Knowledge, Interpersonal and Communication Skills, Practice Based Learning and Improvement, Professionalism, Systems Based Practice, and other criteria established by the Applicable Accrediting Body by Program completion.
2.7 Fully cooperate with the Program Program, Hospital, and the Medical Center FSU GME Office in coordinating and completing all regulatory and RRC and ACGME the Applicable Accrediting Body accreditation submissions and activitiesactivities including, including quality assurance and credentialingbut not limited to, the legible and timely completion of patient medical records, charts, reports, duty hour time logs, statistical operative and procedure logs, faculty and Program evaluations and evaluations, and/or other documentation required by the RRCApplicable Accrediting Body, ACGMEHospital, the Medical CenterHospital Department, Department and/or Program. 2.13 Adhere to all Policies, Procedures and Professional Expectations as outlined in the GME Resident Policy Manual, including policies regarding physician impairment, substance abuse and harassment.
2.14 Permit the Hospital, Program, and authorize the Medical Center FSU GME Office to obtain from and provide to all proper parties any and all information as required or authorized by law or by any accreditation body, including the Applicable Accrediting Body. Trainee hereby covenants and agrees to hold harmless the Hospital, its officers, directors, employees or licensing bodyother personnel for good faith compliance with any such requests for information. This covenant shall will survive the termination or expiration of this Agreement.
2.15 Agree to meet the Hospital and State of Florida standards for immunizations in the same manner as all Hospital personnel.
2.16 Contribute to quality enhancement of education by participating in scheduled evaluations of the Program, faculty and institution.
2.17 Trainee is expected to develop competencies specific to system-based care and to apply cost containment measures in the provision of patient care consistent at all times with the best interest of the patient.
2.18 Trainee shall be subject to Program’s dress code policies and procedures, and professional attire is required as defined by the Program. The Hospital badge must be worn at all times and may not be shared or loaned to other persons.

2.6 Subsequent to the Commencement Date, submit to periodic health examinations and tests, which may include tests for drug use and/or alcohol abuse that are deemed necessary by the Medical Center to ensure that the Trainee is physically, mentally and emotionally capable of performing essential duties and/or are otherwise necessary to the operation comply with any of the Medical Center.
2.7 Subsequent to the Commencement Date, keep up to date with all Employee Occupational Health Services requirements for the duration of employment by the Medical Center. This may involve periodic health examinations or immunizations.
2.8 At the time of the expiration or termination provisions of this Agreement, return all Medical Center property, including, but not limited to, books, equipment, and uniforms; complete all necessary records; and settle all financial and professional obligationsSection “D” shall constitute grounds for disciplinary action.
2.9 Report immediately to the Program Director and to the Medical Center’s Office of General Counsel any inquiry by any private or government attorney or investigator and to the Program Director and Corporate Communications Department any inquiry by a member of the media, in regard to Medical Center business or patient-related matters. The Trainee agrees not to communicate with any inquiring attorney or investigator or member of the media, in regard to Medical Center business or patient- related matters, except for purposes of referral to the appropriate Medical Center office or department or as otherwise required by applicable law.
2.10 Permit and authorize the Medical Center to obtain from and provide to all proper parties any and all information as required or authorized by law or accreditation or licensing body. This covenant shall survive the termination of this Agreement.

Trainee Responsibilities. In providing services and in participating in During the activities term of the ProgramAgreement, the Trainee shall perform the duties and satisfy the requirements described below. Trainee acknowledges that failure to fulfill any or all of these duties and requirements shall be considered a material breach of this Agreement and may lead to corrective action, including but not limited to termination, suspension, probation, or non-renewal of this Agreement.
A. While performing his or her duties at the Hospital or at other locations as directed by the Hospital, the Trainee agrees to do the following:
2.1 Comply fully conduct him/herself in accordance with the Rules and Regulations of the Medical Staff; the Medical Education Policies, Procedures, and other governing documents; the directions of the Graduate Medical Education Committee, the Designated Institutional Official (“DIO”) or Director of Medical Education (“DME”), and the Program Director; the Policies and Procedures of the Hospital and OhioHealth; the Hospital’s House Staff Handbook, if applicable; OhioHealth employment policies; and the OhioHealth Code of Conduct. If this Agreement conflicts with any of the foregoing, this Agreement controls. Trainee must dress and carry out his/her duties in a professional and ethical manner in accordance with State and Federal laws and state licensure standards.
B. If the Trainee has or becomes aware of any health condition that could have an effect on the Trainee’s ability to practice medicine, or if the performance of essential functions of his or her job requires reasonable accommodation in order to facilitate the Trainee’s continued practice of medicine or essential requirements of his or her job, the Trainee shall inform the Program Director and the DIO or DME, who together with OhioHealth’s Associate Health and Wellness Department shall determine what reasonable accommodations, if any, shall be made. Such conditions include but are not limited to, substance abuse, mental illness, physical disability, or contagious diseases such as HIV or tuberculosis.
C. The Trainee must have met and completed all the requirements to receive his or her medical school degree. The degree must be conferred before the Trainee begins the Program. The Trainee must maintain the medical school degree throughout the term of this Agreement and throughout participation in the Program. If any question arises regarding the status of the Trainee’s medical school degree, including revocation or threatened revocation of the degree, the Program may take appropriate and immediate corrective action according to its policies, including but not limited to suspension and/or termination of this Agreement and removal of Trainee from the Program.
D. The Trainee shall meet the requirements and expectations of the Medical Education Department, the Hospital, and the Program by attending assigned responsibilities such as Hospital Committee/Council meetings, completing all assigned medical records, progress notes, charts, reports or other necessary documentation, reading and adhering to the appropriate policies and procedures procedures, satisfactorily completing educational components of the organized Program, and abiding by all Program requirements and expectations such as providing clinical coverage for patients, participating in clinical rotations, taking call as scheduled by the Program and performing such procedures as are assigned and scheduled by the Program under the guidance of faculty and preceptors who shall formally evaluate the service, coverage, participation, and professional performance of the Trainee.
E. The Trainee must maintain a valid training certificate or medical license in the State of Ohio throughout the duration of the Agreement and participation in the Program. Documentation of such licensure or proof of a valid training certificate must be provided to the Department of Medical Staff Education prior to the commencement of this Agreement, if available, and if not available, as soon thereafter as such documentation becomes available. Failure to comply shall permit Program to immediately suspend Trainee or terminate this Agreement. Trainee shall immediately notify the Program of any action taken or contemplated and for which Trainee has received notice which may subject Trainee’s license or training certificate to practice to disciplinary action including but not limited to suspension, revocation, limitation or other restriction. If any question arises regarding the delivery status or validity of clinical care the Trainee’s license or training certificate, the Program may take appropriate and exercise immediate corrective action according to its policies, including but not limited to suspension and/or termination of care decisionthis Agreement and removal of Trainee from the Program.
F. The Trainee must maintain a current and valid National Provider Identification (NPI) number throughout the term of this Agreement and participation in the Program.
G. Trainee shall undergo and successfully pass Hospital’s pre-making responsibilitiesemployment screening before beginning the Program, including but not limited to a pre-employment health screening and physical examination, as well as a criminal background check. Trainee may randomly be requested, and shall comply with any such request, to undergo a blood test, urinalysis, breathalyzer test or other diagnostic test or drug screen at the general policies, procedures, guidelines and directives discretion of ▇▇▇▇ Israel Deaconess Medical Centerthe Program or Hospital due to the critical importance to provide safe quality patient care. Failure to comply with or pass said examination may result in corrective action, including but not limited to the Medical Center’s policies immediate termination of this Agreement and standards applicable to ACGME training programs, removal from the Program.
H. The Trainee shall develop a personal program of self-study for life-long learning and the Medical Center’s policies prohibiting discrimination and sexual harassment professional growth.
I. The Medical Center policy PM-09 Sexual Harassment (“Sexual Harassment Policy”) is attached, and the Trainee must acknowledge receipt obtain and maintain such certifications (e.g., ACLS) during the term of the Sexual Harassment Policy when submitting the executed Agreement..
2.2 Obey and adhere to all applicable state, federal and local laws and regulations, as well as the standards this Agreement reasonably required to maintain accreditation by the Joint Commission on Accreditation of Healthcare Organizations (“JCAHO”), the Accreditation Council for Graduate Medical Education (“ACGME”), the Resident Review Committee (“RRC”), and any other relevant accrediting, certifying, or licensing organization.
2.3 Participate in required educational and scholarly activities of the Program, including the performance of scholarly and research activities as assigned by the Program Director, attend required educational conferences, assume responsibility for teaching and supervising other residents and students, and participate in assigned Medical Center committee activitiesor Hospital from time to time according to Program or Hospital policies.
2.4 Fulfill the educational requirements J. The Trainee shall not submit nor accept fees or other forms of the Program, including compensation from patients or other payers in the areas of the six core competencies required by ACGME.
2.5 Provide clinical service: Commensurate with his/her level of advancement and responsibilities. Under appropriate supervision. At sites specifically approved by the Program. Fully cooperate with the Program and the Medical Center in coordinating and completing all regulatory and RRC and ACGME accreditation submissions and activities, including quality assurance and credentialing, the legible and timely completion of patient medical records, charts, reports, duty hour time logs, statistical operative and procedure logs, faculty and Program evaluations and other documentation required by the RRC, ACGME, the Medical Center, Department and/or Program. Obey and adhere to the Medical Center’s compliance programs and code of conduct.
