This approach provides flexibility by tying the contract's end to real-world developments, ensuring that obligations persist only as long as necessary and addressing situations where the exact end date cannot be predetermined.
/ till *. The Agreement Parties declare that the Agreement constitutes their trade secret and undertake not to disclose (in any form, using any information carriers) the information contained in the Agreement to any third party, regardless of the legal form of action of such third party. The obligation to keep trade secret information confidential shall bind the Parties during the term of this Agreement, as well as for a period of 5 years after its termination - expiration or cancellation or nullification of its legal effects. Subject to commercial confidentiality, the Agreement may be made available to employees of the Agreement Parties to the extent necessary for the performance of the Agreement. In addition, each of the Agreement Parties shall be entitled to disclose the contents of the Agreement at the request of a judicial authority, public administration authority or other authorized entity, to the extent required by applicable law. In the event of any disclosure of the contents of the Agreement referred to in the preceding sentence, the Agreement Party that made such disclosure shall promptly notify the other Agreement Party specifying the entity to whom the contents of the Agreement were disclosed to, as well as the scope and reasons for the disclosure of the contents of the Agreement. / till *. A layer of reddish brown clayey SAND (SC) with gravel, geologically classified as glacial till, was observed below the silty SAND at both boreholes. Trace cobbles were noted within the deposit. Please note, till can be a heterogenous mixture of soil sizes ranging from clay to silt to sand to gravel to cobbles and boulders. The portions of the various soil sizes can vary widely in the deposit. The thickness of the till was determined to be 14.02 meters in BH-4, while BH-1 was terminated within the till layer. The elevation of the till surface ranged from 43.33 to 43.81 meters. N-values from SPT performed within the till ranged from 10 to refusal, with an average of 22, indicating a predominantly compact compactness, ranging from compact to very dense. Three representative samples were submitted for gradation testing and the results are presented in Table 5, and appended. Two samples were submitted for Atterberg Limits and are also presented in Table 5 and appended. The moisture contents of the samples are presented on the Borehole Records. / till *. The term till on the borehole logs indicates that the material originates from a geological process associated with glaciation. Because of this geological process the till must be considered heterogeneous in composition and as such may contain pockets and/or seams of material such as sand, gravel, silt or clay. Till often contains cobbles (60 to 200 mm) or boulders (over 200 mm). Contractors may therefore encounter cobbles and boulders during excavation, even if they are not indicated by the borings. It should be appreciated that normal sampling equipment cannot differentiate the size or type of any obstruction. Because of the horizontal and vertical variability of till, the sample description may be applicable to a very limited zone; caution is therefore essential when dealing with sensitive excavations or dewatering programs in till materials.
