Common use of Third Party Property Clause in Contracts

Third Party Property. Any fixtures, personal property, equipment, trademarks or other intellectual property or other assets which are owned by (A) the supplier or vendor under any Contract, (B) the tenant under any Space Lease, (C) any guests or customers of the Property or (D) the Manager, other than any such property or assets owned by Manager which are used exclusively in connection with the ownership or operation of the Property ((A) – (D), collectively, the “Excluded Personal Property”);

Third Party Property. Any fixtures, personal property, equipment, trademarks or other intellectual property or other assets which are owned by (A) the supplier or vendor under any Contract, (B) the tenant under any Space Lease, and (C) any guests or customers of property manager with respect to the Property or (D) the Manager, other than any such property or assets owned by Manager which are used exclusively in connection with the ownership or operation of the Property ((A) – (D), collectively, the “Excluded Personal Property”)Properties;

Third Party Property. Any fixtures, personal property, equipment, trademarks or other intellectual property or other assets which are owned by (A) the supplier or vendor under any Contract, (B) the tenant under any Space Lease, (C) any guests or customers employees of the Property Sellers, or (D) the Managerany tenant, other than guest, patient or customer of any such property or assets owned by Manager which are used exclusively in connection with the ownership or operation of the Property ((A) – (D), collectively, the “Excluded Personal Real Property”);

Third Party Property. Any fixtures, personal property, equipment, trademarks or other intellectual property or other assets which are owned by (A) the supplier or vendor under any Service Contract, (B) the tenant under any Space Target Property Lease, (C) any guests or customers property managers of any of the Property or Target Properties, and (D) the Managerground lessor under any Target Ground Lease, in each case, other than to the extent of any such property or assets owned by Manager which are used exclusively in connection with the ownership or operation of the Property ((A) – (D)Seller Party’s right, collectively, the “Excluded Personal Property”)title and interest therein;

Any fixtures, personal property, equipment, artwork, trademarks or other intellectual property or other assets which are (A) owned or leased by (Ax) the supplier or vendor under any Contract, (y) Tenants or (z) any property manager or (B) the tenant under leased by Seller or any Space Lease, Affiliate thereof (C) any guests or customers of the Property or (D) the Manager, other than any such property or assets owned by Manager which are used exclusively in connection with the ownership or operation of the Property ((A) – (D), collectively, the “Excluded Personal Property”Acquired Entity);

Any fixtures, personal property, equipment, artwork, trademarks or other intellectual property or other assets which are (A) owned or leased by (Ax) the supplier or vendor under any Contract, (y) Tenants, or (z) the Property Manager, or (B) the tenant under any Space Lease, (C) any guests or customers of the Property or (D) the Manager, other than any such property or assets owned leased by Manager which are used exclusively in connection with the ownership or operation of the Property ((A) – (D), collectively, the “Excluded Personal Property”)Seller;

Third Party Property. Any fixtures, personal property, equipment, trademarks or other intellectual property or other assets which are owned by (A) the supplier or vendor under any Contract, (B) the tenant under any Space Lease, (C) any guests or customers of the Property Manager or (D) the Manager, other than any such property or assets owned by Manager which are used exclusively in connection with the ownership or operation of the Property ((A) – (D), collectively, the “Excluded Personal Property”)Ground Lessor;

Third Party Property. Any fixtures, personal property, equipment, trademarks or other intellectual property or other assets which are owned by (A) the supplier or vendor under any Contract, (B) the tenant under any Space Lease, (C) any Employees, (D) any guests or customers of the Property any Property, or (DE) the Managerany Manager or Franchisor, other than any such property or assets owned by Manager which are used exclusively in connection with the ownership or operation of the Property but excluding ((A) – (D), collectivelyi.e., the “Excluded Personal Property”);following shall be included in Asset-Related Property and transferred to the Buyer at Closing) any rights and/or interests the Sellers may have in the foregoing; and
