Common use of Third Party Development Tools Clause in Contracts

Third Party Development Tools. NCL may authorize third parties to develop and market Development Tools to authorized developers of Games. Notwithstanding any referral or information provided or posted regarding such Development Tools, NCL makes no representations or warranties with regard to any such third party Development Tools. LICENSEE acquires and utilizes such Development Tools at its own risk. LICENSEE shall not, directly or indirectly, use such Development Tools for any purpose except the design and development of Games under this Agreement. All of NCL's Proprietary Rights contained in or derived from such Development Tools shall remain owned by NCL.
