Common use of The Contractor must Clause in Contracts

The Contractor must. 9.4.1. ensure that all sub-contractors undertake their duties and responsibilities with professional skill, care and diligence expected of a service provider experienced in the aspect of the Services to be undertaken by the sub-contractor; 9.4.2. ensure that the sub-contractors do not commence activities until an agreement relating to HSEC issues in line with this Agreement has been concluded between the sub-contractor and Glencore, and the sub-contractor is fully conversant with the provision of and comply with the responsibilities set out in the OHS Act and/or the MHS Act (as applicable) and this Agreement; 9.4.3. manage and co-ordinate the activities of the sub-contractor to ensure compliance with the terms of this Agreement; and 9.4.4. before allowing any sub-contractor on the Site, give Glencore the following details: 9.4.4.1. identity of the sub-contractor and details of the activities to be executed by the sub- contractor; 9.4.4.2. period for which the sub-contractor will be on the Site; and 9.4.4.3. details of the sub-contractor’s employees.
