THE COMPANY DISCLAIMER. Permittee expressly acknowledges that the Company does not represent and warrant that the Company Right-of-Way, whether by easement, franchise, or other form of permission, is broad enough to permit Permittee’s Attachments on the Company Facilities or for the exercise by Permittee of any other rights set forth in this Agreement. It shall be the sole responsibility and obligation of Permittee to secure any such further rights or permission for the placement and use of the Permittee’s Attachments on the Company Facilities and the Company Right-of-Way as may be necessary, including obtaining any permits required by an authorized permitting agency under the California Environmental Quality Act. Permittee shall obtain any such necessary rights from Granting Authorities. “
