The Affected Environment. This sub-section presents a brief description of the physical, biological, and cultural environment for the affected area sites located in the ▇▇▇▇▇▇ Creek watershed in Prince ▇▇▇▇▇▇ County, Virginia. According to the U.S. Census Bureau, Prince ▇▇▇▇▇▇ County has a total area of 265.12 square miles, of which approximately 17 square miles is water (2018). Prince ▇▇▇▇▇▇ County’s altitude ranges from about sea level to 175 feet above sea level. The ▇▇▇▇▇▇ Creek watershed, a tributary to the ▇▇▇▇▇ River, encompasses < 40 square miles. The affected area sites are made-up of two tracts totaling approximately 20 acres of wetlands. Additional acres totaling approximately 289 acres, within the two tracts include riparian protection areas and uplands. These sites are immediately adjacent to the ▇▇▇▇▇ River National Wildlife Refuge (NWR). The ▇▇▇▇▇ River NWR is 4,393 acres of forest and wetland habitats managed for the protection and conservation of native flora and fauna. Specifically the property was established in 1991 to protect the bald eagle (Haliaeetus leucocephalus) and other species of conservation concern. ▇▇▇▇▇▇ Creek forms 4 miles of the NWR’s western boundary. The ▇▇▇▇▇▇ Creek watershed would be affected by proposed acquisition as it would allow for instream habitat improvements, riparian improvements, and water quality benefits by transitioning upland uses. Additionally public benefits include wildlife observation opportunities and potential fishing access.

Toward this end, the Employer shall make every reasonable effort to provide and maintain safe and healthy working conditions and the Union shall fully cooperate by encouraging all employees to perform their assigned tasks in a safe manner.

  • Working Environment The parties agree that a safe and clean working environment is essential in order to carry out work assignments in a satisfactory manner. The Employer commits to investigate the use of environmentally friendly products. It will be the Employer's responsibility to ensure that all working areas and employer-owned vehicles are maintained in a safe and clean condition.

  • O.S.H.A. and Environmental Compliance (a) Borrower has duly complied with, and its facilities, business, assets, property, leaseholds, Real Property and Equipment are in compliance in all material respects with, the provisions of the Federal Occupational Safety and Health Act, the Environmental Protection Act, RCRA and all other Environmental Laws; there have been no outstanding citations, notices or orders of non-compliance issued to Borrower or relating to its business, assets, property, leaseholds or Equipment under any such laws, rules or regulations. (b) Borrower has been issued all required federal, state and local licenses, certificates or permits relating to all applicable Environmental Laws. (i) There are no visible signs of releases, spills, discharges, leaks or disposal (collectively referred to as “Releases”) of Hazardous Substances at, upon, under or within any Real Property or any premises leased by Borrower; (ii) to the best of Borrower’s knowledge, there are no underground storage tanks or polychlorinated biphenyls on the Real Property or any premises leased by Borrower; (iii) to the best of Borrower’s knowledge, neither the Real Property nor any premises leased by Borrower has ever been used as a treatment, storage or disposal facility of Hazardous Waste; and (iv) no Hazardous Substances are present on the Real Property or any premises leased by Borrower, excepting such quantities as are handled in accordance with all applicable manufacturer’s instructions and governmental regulations and in proper storage containers and as are necessary for the operation of the commercial business of Borrower or of its tenants.

  • NON-SEXIST ENVIRONMENT 1. A non-sexist environment is defined as that in which there is no discrimination against females or males by portraying them in gender stereotyped roles or by omitting their contributions. 2. The employer does not condone and will not tolerate any written or verbal expression of sexism. In September of each school year the employer and the local shall jointly notify administrative officers and staff, in writing, of their commitment to a non-sexist environment. 3. The employer and the local shall promote a non-sexist environment through the development, integration, and implementation of non-sexist educational programs, activities, and learning resources for both staff and students.
