Termination or variation by order. ‌ (a) Notwithstanding any other provision of this Agreement, this Agreement may be terminated or varied by the Minister by order published in the Gazette in accordance with section 308(4) of the EPBC Act. (b) If the Minister varies this Agreement by an order made under section 308(4) of the EPBC Act, this Agreement may be terminated by Council in accordance with section 308(7) of the EPBC Act. (c) In accordance with section 308(8) of the EPBC Act, if the Agreement is terminated or varied by an order, Council is not entitled to any compensation in respect of the termination or variation.
