Common use of Termination of Existing Contracts Clause in Contracts

Termination of Existing Contracts. Any Participating Member desiring to avail itself of the benefits of this Agreement may, at its option and without liability, terminate any existing contract(s) or other arrangement(s) with Seller for the purpose of participating in the group purchasing arrangement set forth in this Agreement except as follows: the foregoing does not entitle a Participating Member to terminate any Committed Purchase Agreement as defined in Section 2.
