Starkey may terminate this ---------------------------- Agreement immediately upon notice if (i) a court of competent jurisdiction determines in a non-appealable final judgment that the Hybrid infringes the Intellectual Property rights of a third party, or (ii) the use, manufacture, sale, offer for sale or import of Hybrids is enjoined as the result of such Hybrid's infringement of a third party's Intellectual Property rights.
