TERMINATION BY ACTIVBIOTICS. ActivBiotics may terminate this Agreement (a) immediately at any time upon written notice to Consultant in the event of a breach of this Agreement by Consultant which cannot be cured (i.e. breach of the confidentiality obligation) and/or (b) at any time without cause upon not less than thirty (30) days' prior written notice to Consultant.
