Term of Deferment Option. Xxxxxxxxx’x Deferment Option shall continue from year-to-year until the later of: (a) the amendment or termination of the Credit Facility insofar as it prohibits or restricts distributions by Xxxxxxxxx Resource Partners, L.P. to its limited partners as set forth above; or (b) WMD has acquired sole ownership of the Subject Assets.
