Common use of Tenant’s Compensation/Liability Clause in Contracts

Tenant’s Compensation/Liability. In no case shall Tenant be compensated by Landlord for damages or loss in the use of the Premises or for any inconvenience occasioned by such damage or restoration. Notwithstanding Section 10.3, if any damage is caused by the negligence or improper conduct of Tenant or any of Tenant’s employees, agents, contractors, licensees or invitees, Tenant shall be responsible for all damages not covered by insurance, including without limitation, any deductible paid by Landlord and Rent through the Term hereof, even if this Lease shall have been terminated.

Notwithstanding Section 10.311.5, if any damage is caused by the negligence or improper conduct of Tenant or any of Tenant’s 's employees, agents, contractors, licensees or invitees, Tenant shall be responsible for all damages not covered by insurance, including without limitation, any deductible paid by Landlord and Rent through the Term hereof, even if this Lease shall have been terminated.
