Landlord Liability. Tenant, its successors, and assigns shall not assert nor seek to enforce any claim for breach of this Lease against any of Landlord’s assets other than Landlord’s interest in the Industrial Center. Tenant agrees to look solely to such interest for the satisfaction of any liability or claim against Landlord under this Lease. In no event whatsoever shall Landlord (which term shall include, without limitation, any general or limited partner, trustees, beneficiaries, officers, directors, or stockholders of Landlord) ever be personally liable for any such liability.

Landlord Liability. Tenant shall neither assert nor seek to enforce any claim for breach of this Lease against any of Landlord’s assets other than Landlord’s interest in the Office Area (including uncollected rent, insurance and condemnation, but subject to the rights of any mortgagee and to Landlord’s right to use any insurance and condemnation proceeds for the purposes of repairing and restoring the Office Area), and Tenant agrees to look solely to such interest for the satisfaction of any liability of Landlord under this Lease, it being specifically agreed that neither Landlord, nor any successor holder of Landlord’s interest hereunder, nor any beneficiary of any Trust of which any person from time to time holding Landlord’s interest is Trustee, nor any such Trustee, nor any member, manager, partner, director or stockholder nor Landlord’s managing agent shall ever be personally liable for any such liability. This paragraph shall not limit any right that Tenant might otherwise have to obtain injunctive relief against Landlord or Landlord’s successors-in-interest, or to take any other action which shall not involve the personal liability of Landlord, or of any successor holder of Landlord’s interest hereunder, or of any beneficiary of any trust of which any person from time to time holding Landlord’s interest is Trustee, or of any such Trustee, or of any manager, member, partner, director or stockholder of Landlord or of Landlord’s managing agent, to respond in monetary damages from Landlord’s assets other than Landlord’s interest in said Office Area, as aforesaid, but in no event shall Tenant have the right to terminate or cancel this Lease or to withhold rent or to set-off any claim or damages against rent as a result of any default by Landlord or breach by Landlord of its covenants or any warranties or promises hereunder, except in the case of a wrongful eviction of Tenant from the Premises (constructive or actual) by Landlord continuing after notice to Landlord thereof and a reasonable opportunity for Landlord to cure the same. In no event shall Landlord ever be liable for any indirect or consequential damages or loss of profits or the like. In the event Landlord is in breach or default with respect to Landlord's obligations or otherwise under this Lease, Tenant shall look solely to the equity of Landlord in the Building for the satisfaction of Tenant's remedies. Landlord Liability. Except in the case of the negligence or willful misconduct of Landlord and the extent permitted by Applicable Laws, Landlord shall not be liable to Tenant for any damage, injury, loss or claim (including claims for the interruption of or loss to business) based on or arising out of any of the following: repair to any portion of the Premises or the Building; interruption in the use of the Premises or any equipment therein; any accident or damage resulting from any use or operation (by Landlord, Tenant or any other person or entity) of elevators or heating, cooling, electrical, sewerage or plumbing equipment or apparatus; termination of this Lease by reason of damage to the Premises or the Building; fire, robbery, theft, vandalism, mysterious disappearance or any other casualty; actions of any other tenant of the Building or of any other person or entity; failure or inability of Landlord to furnish any utility or service specified in this Lease; and leakage in any part of the Premises or the Building, or from water, rain, ice or snow that may leak into, or flow from, any part of the Premises or the Building, or from drains, pipes or plumbing fixtures in the Premises or the Building. Any property stored or placed by Tenant or Tenant Parties in or about the Premises or the Building shall be at the sole risk of Tenant, and Landlord shall not in any manner be held responsible therefor. Notwithstanding the foregoing provisions of this Section or any other Section of this Lease and subject to the terms of Section 13.4, Landlord shall not be released from liability to Tenant for any damage to the extent caused by Landlord’s willful misconduct or negligence.
Landlord Liability. The Landlord will not be liable to Tenant, Xxxxxx’s family, guests, invitees or agents for any damages or losses to person or property caused by other tenants of the building or by any other third parties. Xxxxxx agrees to indemnify (reimburse if necessary), defend and hold Landlord harmless against all claims for damages to property or persons arising from Tenant’s use of the Apartment, or from any activity, work or thing done by Tenant or by any permitted pet in or about the Apartment (including legal fees and court costs Landlord incurs). Landlord will not be liable for personal injury or damage or loss of Xxxxxx’s personal property (furniture, jewelry, clothing, automobiles, food or medication in the refrigerator, etc.) resulting from theft, vandalism, fire, water, rain, snow, ice, storms, earthquakes, sewerage, streams, gas, electricity, smoke, explosions, sonic booms, or other causes or resulting from any breakage or malfunction of any pipes, plumbing fixtures, air conditioner, or appliances, unless it is due to Landlord’s failure to perform, or negligent performance of, a duty imposed by law. Landlord will not be liable to Tenant for any loss or injury due to interruption or curtailment of heat, hot water, air conditioning, or any other service furnished to Tenant, except as provided by law. Tenant(s) agree not to withhold any Rent or additional rent, nor will Rent or additional rent be abated, as a result of such interruption or curtailment. Nothing in this Paragraph 35 shall be construed to waive Landlord’s warranty of habitability, or to limit Tenant’s remedies in the event of a breach of that warranty. This agreement by Xxxxxx to indemnify (reimburse if necessary), defend and hold Landlord harmless against all claims for damages to property or persons arising from Tenant’s use of the Apartment specifically includes, but is not limited to, Xxxxxx’s use of the amenity areas and health facilities, if any, at the premises. Neither the Landlord nor Xxxxxxxx’s affiliates, agents, employees, successors or assigns, will be liable for any claims, causes of action or damages arising out of personal injury, property damage or loss that may be sustained in connection with the amenity areas and health facilities either by Tenant or by any persons Tenant allows to use such areas or facilities, unless such claim or damage arises from Landlord’s failure to perform, or negligent performance of, a duty imposed by law. Landlord Liability. The Landlord shall not be liable for any death, injury, loss or damage of any nature whatsoever which may be suffered by the Tenant(s) or any other person who may be upon the Rental Unit, the Rental Complex or the Premises. The Landlord shall not be liable for any loss or damage to any property at any time in the Rental Unit, the Rental Complex or upon the Premises from theft, burglary or vandalism or from fire, smoke, electrical wiring, gas, water, steam, waterworks, rain, ice or snow which may leak into, issue or flow from any part of the Building or the exterior appendages of the Building or the land immediately contiguous to the Building of which the Rental Unit is a part, or from the pipes or plumbing works of the same or from any other place or quarter, where damage has occurred as a result of the negligent act, omission or delay of the Landlord, its directors, officers, employees, agents, or contractors.

Landlord Liability. The liability of Landlord and all officers, employees, shareholders, venturers or partners (general or limited) of Landlord to Tenant for any default by Landlord under the terms of this Lease shall be non-recourse and limited to the interest of Landlord in the Building, and Landlord or any officer, employee, shareholder, venturer or partner (general or limited) of Landlord shall have the right to sell or transfer all or any portion of the Land or the Building to any third party, and upon any such sale or other transfer of all of the Building or the Land, and the corresponding assignment of this lease, the previous Landlord shall have no further liability or obligation to Tenant hereunder or otherwise for obligations arising after the date of transfer.
