System Use. Subject to the County’s obligations of Acceptance set forth in Attachment A.1 (Tasks and Deliverables) to Exhibit A (Statement of Work), and this Contract, following Solution Implementation by Contractor and prior to Final Acceptance by the County, the County will have the right to use, in a Production Use mode, any completed portion of the System, without any additional cost to the County where County determines that it is necessary for County’s operations. Such Production Use will not restrict Contractor’s performance under this Contract and will not be deemed Final Acceptance of the Solution.
System Use. Computer equipment and services provided by a CoC are intended only for LA HMIS-related activities. Prohibited uses include, but are not limited to: malicious or illegal activities; unauthorized access; the creation, sending and/or storing of fraudulent, threatening, harassing, or obscene messages; inappropriate mass mailing (spamming, flooding, bombing); denial of service attacks; and the creation or intentional distribution of computer viruses, worms, and/or Trojan horses.
System Use. User agrees to use the BCICS and maintain its County-assigned or User-owned radio equipment in accordance with Federal Communications Commission (FCC) rules and regulations and in accordance with BCICS policies and procedures. System Use. You: (a) warrant that you have the legal right to subject the computer systems and network infrastructure (Target Systems) to the Information Security Service and that if you are not the owner of the Target Systems that you have obtained the right from the legal owner of the Target Systems; (b) are responsible for the protection and backup of data and equipment used in connection with or having any connection to the Target Systems (Affected Systems) and that you have protected and backed up all Affected Systems; and (c) grant us a right to use your Target systems, other systems, proprietary and third party products, Confidential Information, customer data and information as necessary to perform the Information Security Service.
System Use. (a) Client shall use the System solely for its own internal business purposes. Client shall ensure that (i) only persons authorized by Client access and use the System, and (ii) all Orders are authorized by Client and sent by a duly authorized and qualified representative of Client either for Client’s account or an account over which Client has investment discretion (collectively, “Accounts”), or for a trade for which Client has received express consent. Client acknowledges that it may not be allowed to use the System for its omnibus accounts in all jurisdictions.
System Use. Provided that County is paying the applicable Maintenance Fees in accordance with the terms of this Agreement, following installation by Contractor and prior to Final Acceptance by County, County shall have the right to use, in a Production Use mode, any completed portion of the System, without any additional cost to County above such applicable Maintenance Fees. Any Production Use of a System Component for which there is an available test system that extends for a period of forty-five (45) days or more shall be deemed an Acceptance of the applicable System Component.
