Common use of Suspension of Delivery Clause in Contracts

Suspension of Delivery. SPD shall be entitled to suspend delivery of electricity from the System to the Delivery Point for the purpose of maintaining and repairing the System upon giving one week’s advance written notice to the Buying Entity, except in the case of emergency repairs. Such suspension of Service shall not constitute a breach of this Agreement, provided that the SPD shall use commercially reasonable efforts to minimize any interruption in service to the Buying Entity. However, any preventive maintenance shall be done only during the period when Plant is not generating.

The SPD shall be entitled to suspend delivery of electricity from the System Project to the Delivery Point Point(s) for the purpose of maintaining and repairing the System Project upon giving one week’s notice of at least three (3) Days in advance written notice to the Buying EntityProcurer, except in the case of emergency repairs. Such suspension of Service service shall not constitute a breach of this AgreementPPA, provided that the SPD shall use commercially reasonable efforts to minimize any interruption in service to the Buying EntityProcurer. However, any preventive maintenance shall be done only during the period when Plant Project is not generating.
