Survey Marks. 3.22.1 In this Section 3.22, “survey ▇▇▇▇” means a survey peg, bench ▇▇▇▇, reference ▇▇▇▇, signal alignment, level ▇▇▇▇ or other ▇▇▇▇ used for the purpose of setting out, checking or measuring the Work. 3.22.2 Unless stated otherwise in this Agreement, MSG must supply to Contractor the information and survey marks necessary to enable Contractor to set out the Work. It is Contractor’s responsibility to accurately set out the Work based on these survey marks and information, after verifying their correctness. 3.22.3 Contractor must rectify any disturbance or obliteration of MSG’s survey marks unless the disturbance or obliteration was caused by MSG or someone for whom MSG is responsible.
Survey Marks. The Contractor shall keep in their true positions all survey marks. If a survey mark is disturbed or obliterated, the Contractor shall immediately notify Essential Energy’s Representative. The Contractor must reinstate the survey mark unless otherwise directed by Essential Energy’s Representative. If the disturbance or obliteration is caused by Essential Energy’s Representative or a person referred to in clause 3(e) other than the Contractor or its subcontractors, employees or agents, the cost incurred by the Contractor in reinstating the survey mark shall be valued under clause 14.3.
Survey Marks. Survey marks such as bench mark pillars, alignment and boundary pillars shall be protected against damages by the contractor. All excavation and filling around such mark shall be done in the manner approved by the Engineer-in-charge to ensure their safety and accuracy. The con-tractor shall be responsible to pay all the damages done to these marks by his labour/staff. 2.1 Any finds made on the site of work such as relics or antiquated other valuable or any other materials etc. shall be the absolute property of the government of Uttar Pradesh and shall be handed over intact by the contractor to the Engineer-in-charge. The contractor shall take reasonable precautions to prevent his workmen or any other person or persons from removing or damaging any such articles or things and shall immediately on discovery there of before removal inform the Engineer-in-charge.
Survey Marks. (1) In this clause 8.2, “survey mark” means a survey peg, bench mark, reference mark, signal alignment, level mark or other mark used for the purpose of setting out, checking or measuring the Work under the Contract. (2) Unless stated otherwise in the Contract, [*****] must supply to the Subcontractor the information and survey marks necessary to enable the Subcontractor to set out the Works. It is the Subcontractor’s responsibility to accurately set out the Work under the Contract based on these survey marks and information, after verifying their correctness. (3) If at any time during the execution of the Work under the Contract, any error appears in the positions, levels, dimensions or alignment of any part of the Work under the Contract, the Subcontractor must rectify any disturbance or obliteration of [*****]’s survey marks at its own cost unless the disturbance or obliteration was caused by [*****]. (4) The Subcontractor acknowledges, agrees and accepts that it is responsible for the provision of all necessary instruments, equipment, apparatus and labour in connection with this clause 8.2.
