Common use of Surrender/Restoration Clause in Contracts

Surrender/Restoration. Lessee shall surrender the Premises by the end of the last day of the Lease term or any earlier termination date, clean and free of debris and in good operating order, condition and state of repair, ordinary wear and tear excepted. Ordinary wear and tear shall not include any damage or deterioration that would have been prevented by good maintenance practice or by Lessee performing all of its obligations under this Lease. Except as otherwise agreed or specified herein, the Premises, as surrendered, shall include the Alterations and Utility Installations. The obligation of Lessee shall include the repair of any damage occasioned by the installation, maintenance or removal of Lessee's Trade Fixtures, furnishings, equipment, and Lessee-Owned Alterations and Utility Installations, as well as the removal of any storage tank installed by or for Lessee, and the removal, replacement, or remediation of any soil, material or ground water contaminated by Lessee, all as may then be required by Applicable Requirements and/or good practice. Lessee's Trade Fixtures shall remain the property of Lessee and shall be removed by Lessee subject to its obligation to repair and restore the Premises per this Lease.

Lessee shall surrender the Premises by the end of the last day of the Lease term Expiration Date or any earlier termination date, with all of the improvements, parts and surfaces thereof broom clean and free of debris debris, and in good operating order, condition and state of repair, ordinary wear and tear tear, casualty, condemnation, and damage attributable to the willful misconduct or negligence of Lessor, its agents, employees and contractors, and damage attributable to Lessor's default hereunder excepted. "Ordinary wear and tear tear" shall not include any damage or deterioration that would have been prevented by good maintenance practice or by Lessee performing all of its obligations under this Leasepractice. Except as otherwise agreed or specified herein, the Premises, as surrendered, shall include the Alterations and Utility Installations. The obligation of Lessee shall include the repair of any damage occasioned by the installation, maintenance or removal of Lessee's Trade Fixtures, furnishings, equipment, and Lessee-Lessee Owned Alterations and and/or Utility Installations, furnishings, and equipment as well as the removal of any storage tank installed by or for Lessee, and the removal, replacement, or remediation of any soil, material or ground water groundwater contaminated by Lessee, all as may then be required by Applicable Requirements and/or good practice. Lessee's Trade Fixtures shall remain the property of Lessee and shall be removed by Lessee. The failure by Lessee subject to its obligation to repair and restore timely vacate the Premises per pursuant to this Lease.Paragraph 7.4

Surrender/Restoration. Lessee shall surrender the Premises by the end of the last day of the Lease term Expiration Date or any earlier termination date, with all of the improvements, parts and surfaces thereof clean and free of debris debris, and in good operating order, condition and state of repair, ordinary wear and tear excepted. "Ordinary wear and tear tear" shall not include any damage or deterioration that would have been prevented by good maintenance practice practice. Notwithstanding the foregoing, if this Lease is for 12 months or by Lessee performing all of its obligations under this Lease. Except as otherwise agreed or specified hereinless, the Premises, as surrendered, shall include the Alterations and Utility Installations. The obligation of then Lessee shall include surrender the Premises in the same condition as delivered to Lessee on the Start Date with NO allowance for ordinary wear and tear. Lessee shall repair of any damage occasioned by the installation, maintenance or removal of Lessee's Trade Fixtures, furnishings, equipment, and Lessee-Lessee Owned Alterations and and/or Utility Installations, furnishings, and equipment as well as the removal of any storage tank installed by or for Lessee, . Lessee shall also completely remove from the Premises any and all Hazardous Substances brought onto the removal, replacement, Premises by or remediation of any soil, material or ground water contaminated by for Lessee, all as may then be required by Applicable Requirements and/or good practice(except Hazardous Substances which were deposited via underground migration from areas outside of the Project). Lessee's Trade Fixtures shall remain the property of Lessee and shall be removed by Lessee subject to its obligation to repair and restore the Premises per this Lease.

Lessee shall surrender the Premises by the end of the last day of the Lease term or any earlier termination date, clean and free of debris and in good operating order, condition and state of repair, ordinary wear and tear excepted. The obligation of Lessee shall include the repair of any damage occasioned by the installation, maintenance or removal of Lessee's ’s Trade Fixtures, furnishings, equipment, and Lessee-–Owned Alterations and Utility Installations, as well as the removal of any storage tank installed by or for Lessee, and the removal, replacement, or remediation of any soil, material or ground water contaminated by Lessee, all as may then be required by Applicable Requirements and/or good practice. Lessee's ’s Trade Fixtures shall remain the property of Lessee and shall be removed by Lessee subject to its obligation to repair and restore the Premises per this Lease.

Lessee's Trade Fixtures shall remain the property of Lessee and shall be removed by Lessee subject to its obligation to repair and restore the Premises per this Lease.

Lessee's Trade Fixtures shall remain the property of Lessee and shall be removed by Lessee subject to its obligation to repair and restore the Premises per this Lease.

Surrender/Restoration. Except as otherwise agreed or specified hereinin writing by Lessor, the Premises, as surrendered, shall include the Alterations and Utility Installations. The obligation of Lessee shall include the repair of any damage occasioned by the installation, maintenance or removal of Lessee's Trade Fixtures, furnishings, equipment, and Lessee-Owned Alterations and and/or Utility Installations, as well as the removal of any storage tank installed by or for Lessee, and the removal, replacement, or remediation of any soil, material or ground water contaminated by Lessee, all as may then be required by Applicable Requirements Law and/or good practice. Lessee's Trade Fixtures shall remain the property of Lessee and shall be removed by Lessee subject to its obligation to repair and restore the Premises per this Lease. (See Paragraph 49(e).)

Lessee's Trade Fixtures shall remain the property of Lessee and shall be removed by Lessee subject to its obligation to repair and restore the Premises per as provided under this this Lease.

Lessee's Trade Fixtures shall remain the property of Lessee and shall be removed by Lessee subject to its obligation to repair and restore the Premises per this Lease.

Except as otherwise agreed or specified hereinin writing by Lessor, the Premises, as surrendered, shall include the Alterations and Utility Installations. The obligation of Lessee shall include the repair of any damage occasioned by the installation, maintenance or removal of Lessee's Trade Fixtures, furnishings, equipment, and Lessee-Owned Alterations and and/or Utility Installations, as well as the removal of any storage tank installed by or for Lessee, and the removal, replacement, or remediation of any soil, material or ground water contaminated by Lessee, all as may then be required by Applicable Requirements Law and/or good service practice. Lessee's Trade Fixtures shall remain the property of Lessee and shall be removed by Lessee subject to its obligation to repair and restore the Premises per this Lease.

Lessee's Trade Fixtures shall remain the property Property of Lessee and shall be removed by Lessee subject to its obligation to repair and restore the Premises per this Lease.

Lessee's Trade Fixtures shall remain the property of Lessee and shall be removed by Lessee subject to its obligation to repair and restore the Premises per this Lease.repair. [15]

Lessee's Trade Fixtures shall remain the property properly of Lessee and shall be removed by Lessee subject to its obligation to repair and restore the Premises per this Lease.

The obligation of Lessee shall include the repair of any damage occasioned by the installation, maintenance or removal of Lessee's Trade Fixtures, furnishings, equipment, and Lessee-Owned Alterations and Utility Installations, as well as the removal of any storage tank installed by or for Lessee, and the removal, replacement, or remediation of any soil, material or ground water contaminated by Lessee, all as may then be required by Applicable Requirements and/or good practice. Lessee's Trade Fixtures shall remain the property of Lessee and shall be removed by Lessee subject to its obligation to repair and restore the Premises per this Lease.. See Paragraph 58

Surrender/Restoration. Lessee's Trade Fixtures shall remain the property of Lessee and shall be removed by Lessee. The failure by Lessee subject to its obligation to repair and restore timely vacate the Premises per pursuant to this subparagraph without the express written consent of Lessor shall constitute a holdover under the provisions of this Lease.

Lessee's Trade Fixtures shall remain the property of Lessee and shall be he removed by Lessee subject to its obligation to repair and restore the Premises per this Lease. See Paragraph 7.4(c) of the Addendum attached hereto.

Surrender/Restoration. Lessee shall surrender the Premises by the end of the last day of the Lease term or any earlier termination date, with all of the improvements, parts and surfaces thereof clean and free of debris and in good operating order, condition and state of repair, ordinary wear and tear excepted. Lessee's Trade Fixtures shall remain the property of Lessee and shall be removed by Lessee subject to its obligation to repair and restore the Premises per this Leaselease.
