Surcharge. If, during the Term, any existing laws or regulations are changed or any new laws or regulations are enacted that require TLO to make substantial and unanticipated expenditures (whether capitalized or otherwise) with respect to the Terminal, TLO may, subject to the terms of this Section 11, impose a surcharge to increase the applicable service fee (“Surcharge”), to cover Customer’s pro rata share of the cost of complying with these laws or regulations, based upon the percentage of Customer’s use of the services or facilities impacted by such new laws or regulations.
Surcharge. Barracudas reserves the right to surcharge published prices if there is an increase in the rate of VAT above 20% prior to the commencement of the holiday.
Surcharge. 10.8.1 Any amount due from one Party to the other, pursuant to this Agreement and remaining unpaid for thirty (30) days after the Due Date, shall bear Late Payment Surcharge @ 1.25% per month on the unpaid amount. Surcharge. Owner agrees to pay a surcharge of $65.00 per month. This surcharge amount will be paid in addition to City water rates and usage charges established by the Municipal Code. This monthly surcharge shall continue to be billed and collected until such time as the project costs to be recouped by the City have been collected. Once the project costs have been recouped, the surcharge will be removed from the next billing cycle. The City agrees that the surcharge will not be increased while this Agreement is in effect.
