Support for Secretarial Determination Clause Samples
The Support for Secretarial Determination clause establishes the parties' obligation to assist or cooperate with determinations made by the Secretary, typically in a regulatory or administrative context. In practice, this may require providing information, documentation, or other forms of support necessary for the Secretary to make informed decisions or fulfill statutory duties. The core function of this clause is to ensure that the Secretary has the necessary cooperation from involved parties to carry out official responsibilities efficiently and in compliance with applicable laws.

The Secretary, in cooperation with the Secretary of Commerce and other Federal agencies as appropriate, will: (i) use existing studies and other appropriate data, including those in the FERC record for this project, including but not limited to environmental impact studies, EPAct proceedings, and other pertinent material;
