Common use of Supplements and Amendments; Whole Agreement Clause in Contracts

Supplements and Amendments; Whole Agreement. This Warrant may be amended or supplemented only by an instrument in writing signed by the Company and the holders representing a majority in interests of the Applicable Warrant Shares that remain issuable under the then outstanding Warrants. This Warrant contains the full understanding of the parties hereto with respect to the subject matter hereof and thereof and there are no representations, warranties, agreements or understandings other than expressly contained herein and therein.

This Warrant may be amended or supplemented only by an instrument in writing signed by the Company and a majority of the holders representing a majority in interests of all Warrant Shares issuable upon exercise of the Applicable Warrant Shares that remain issuable under the then outstanding Series Warrants. This Warrant contains and the related Note executed concurrently contain the full understanding of the parties hereto with respect to the subject matter hereof and thereof and there are no representations, warranties, agreements or understandings other than expressly contained herein and therein.

Supplements and Amendments; Whole Agreement. This Warrant may be amended or supplemented or any provision hereof waived only by an instrument in writing signed by the Company and the holders representing a majority Holders of more than 50% in interests interest of the Applicable Warrant. Any amendment or supplement or waiver approved by Holders of more than 50% in interest of the Warrant Shares that remain issuable under shall be binding on all the then outstanding WarrantsHolders thereof. This Warrant contains the full understanding of the parties hereto with respect to the subject matter hereof and thereof and there are no representations, warranties, agreements or understandings other than expressly contained herein and therein.
