Common use of Sufficient Progress Clause in Contracts

Sufficient Progress. The President and Treasurer of the Company shall have certified to the Board that the Company has met the milestones specified in Exhibit 5.3(d) hereof with respect to the Final Closing, and the Board, by a resolution adopted by action of a majority of the directors, which majority includes all Investor Designee(s), shall have concurred with such determination and shall have deemed it advisable for the Final Closing to occur.
