Common use of Success Fee-C Clause in Contracts

Success Fee-C. In addition to any other Success Fee as set forth in this Agreement, Borrower will pay to Bank a fee in the amount of $30,000 (the “Success Fee-C”) immediately upon the completion of a merger or acquisition transaction involving Borrower and any other person, subject to Sections 7.2 and 7.3 hereof, wherein all or substantially all of the Borrower or its assets are acquired, made subject to a Merger Event.
