Common use of Subsequent Application Clause in Contracts

Subsequent Application. In the event TelCove or TelCove’s Guest(s) desires to modify the Collocation Space after a BFFO, TelCove shall complete an application that contains all of the detailed information associated with an Alteration to the Collocation Space, as defined in Section 5.23 above (“Subsequent Application”). The Subsequent Application is considered Bona Fide when it is complete and accurate, meaning that all of the required fields on the Subsequent Application are completed with the appropriate type of information associated with the Alteration. BellSouth shall determine what modifications, if any, to the Premises are necessary to accommodate the change requested by TelCove in the application. Such modifications to the Premises may include, but are not limited to: floor loading changes, changes necessary to meet HVAC requirements, changes to power plant requirements, equipment additions, etc.

In the event TelCove Teleconex or TelCoveTeleconex’s Guest(s) desires to modify the use of the Collocation Space after a BFFO, TelCove Teleconex shall complete an application that contains all of the detailed information associated with an Alteration Augment to the Collocation Space, as defined in Section 5.23 above 5.13 of this Attachment (“Subsequent Application”). The Subsequent Application is considered Bona Fide when it is complete and accurate, meaning that all of the required fields on the Subsequent Application are completed with the appropriate type of information associated with the AlterationAugment. BellSouth shall determine what modifications, if any, to the Premises are necessary required to accommodate the change requested by TelCove Teleconex in the application. Such modifications to the Premises may include, but are not limited to: floor loading changes, changes necessary to meet HVAC requirements, changes to power plant requirements, equipment additions, etc.
