Common use of Subrogation Language Clause in Contracts

Subrogation Language. Where an Employee receives compensation for time lost from work from any third party, such as the Insurance Company of British Columbia (ICBC), the Workers’ Compensation Board (WCB), a court order, etc., any amounts paid by the Employer on behalf of the Employee for such situations, such as sick leave, for example, must be refunded to the Employer. Any other costs incurred by the Employer and recovered from the third party may also be repayable, such as the cost of benefits for example. The Employer shall thereupon reinstate the sick leave credits represented by the repayment of wages and recover its costs for benefits or other items previously paid for by the Employer. Credits will be reinstated at the rate at which they were paid.
