Common use of Subcontractors Clause in Contracts

Subcontractors. Nothing in this Agreement shall prevent a Party from utilizing the services of any subcontractor as it deems appropriate to perform its obligations under this Agreement; provided, however, that each Party shall require its subcontractors to comply with all applicable terms and conditions of this Agreement in providing such services and each Party shall remain primarily liable to the other Party for the performance of such subcontractor.

Nothing in this Agreement shall prevent a Party from utilizing the services of any subcontractor as it deems appropriate to perform its obligations under this Agreement; provided, however, that each Party shall require its subcontractors to comply with all applicable terms and conditions of this Agreement in providing such services and each Party shall remain primarily liable to the other Party PartyParties for the performance of such subcontractor.

Subcontractors. Nothing in this Agreement shall prevent preclude a Party party from utilizing the services of any employing a subcontractor as it deems appropriate to perform in carrying out its obligations under this Agreement; provided, however, that each Party shall require its subcontractors to comply with all applicable terms and conditions of this Agreement in providing such services and each Party shall remain primarily liable to the other Party for the performance . A party’s use of such subcontractorsubcontractor shall not release the party from its obligations under this Agreement.

Subcontractors. Subcontractors. 3.9.13.10.1. Nothing in this Agreement shall prevent a Party from utilizing using the services of any subcontractor as it deems appropriate to perform its obligations under this Agreement; provided, however, that each Party shall require require, and shall provide in its contracts with its subcontractors, that its subcontractors to comply with all applicable terms and conditions of this Agreement in providing such services and services; provided, further, that each Party shall remain primarily liable to the other Party for the performance of such subcontractor.

Nothing in this Agreement shall prevent a Party party from utilizing the services of any subcontractor subcontractor, or designating a third party agent as one responsible for a specific obligation or act required in this Agreement (collectively “Subcontractors”), as it deems appropriate to perform its obligations under this Agreement; provided, however, that each Party shall party will require its subcontractors Subcontractors to comply with all applicable terms and conditions of this Agreement in providing such services and and, subject to the application provisions of this Agreement, each Party shall will remain primarily liable to the other Party for the performance of such subcontractorSubcontractor.

However, no subcontracting arrangement shall prevent a release either Party from utilizing the services of any subcontractor as it deems appropriate to perform its responsibilities and obligations under this Agreement; provided. Each Party shall be fully responsible for the work and activities of each of its subcontractors, howeverincluding compliance with the terms of this Agreement. Additionally, that each Party shall require be responsible for all payments to its subcontractors to comply with all applicable terms and conditions of this Agreement in providing such services and each Party shall remain primarily liable to the other Party for the performance of such subcontractorsubcontractors.
